President Clinton, who first nominated DeSeve in March, announced the appointment this month. He acted under a provision that allows the president to make an appointment while Congress is not in session.
Under the terms of the provision, DeSeve's term will expire at the end of the first session of the 106th Congress unless the Senate approves the nomination, which Clinton plans to resubmit.
