Supreme Court Ends Oracle’s JEDI Challenge

Oracle first challenged the Pentagon’s Joint Enterprise Defense Infrastructure cloud contract in 2018.
The Supreme Court this week denied Oracle’s petition to review longstanding claims the company has made that the Defense Department erred in crafting its now-canceled Joint Enterprise Defense Infrastructure cloud contract as a single-source contract.
The contract, eventually awarded to Microsoft twice, was ultimately canceled in July in favor of a new effort called the Joint Warfighter Cloud Capability, or JWCC.
Oracle first protested the JEDI contract in August 2018 with the Government Accountability Office, and later took its legal arguments to the U.S. Court of Federal Claims and the U.S. Court of Appeals. Ultimately, all three venues dismissed or denied Oracle’s claims.
Oracle continued its legal fight even after JEDI’s cancelation, arguing in an Oct. 1 filing that its claims should not be moot simply because the Pentagon canceled the contract. The Supreme Court, however, followed a May recommendation from Acting Solicitor General Elizabeth Prelogar to deny Oracle’s petition because lower courts properly decided the case.
